This is the Privacy Policy (“Policy”) for VVF Science, LLC (“VVF”, “our”, “we”, “us”, whether capitalized or lowercase).

This Privacy Policy describes how we may collect, use, share or otherwise process personal information, particularly in association with our marketing and business development practices and the operation of our websites, portals, mobile applications, email correspondence, and any of our social media channels (collectively, our “Platforms”), and in connection with any of our services, classes or events, video training, tools or products (collectively, our “Products”).

Before accessing or using our Platforms or Products, please ensure that you have read and understood our collection, storage, use and disclosure of your personal information as described in this Policy. By accessing or using our Platforms or Products, you are accepting and consenting to the practices described in this Policy.

Please note that this Policy only pertains to our Platforms, the information and/or Products offered on the Platforms and your interaction with our Platforms.  To the extent that you desire to engage VVF to perform custom services for you, such services, and all related privacy rights and obligations, will be governed by a written agreement entered into by you and VVF and will supersede this Privacy Policy.

A. THE TYPES OF INFORMATION WE COLLECT

We collect your personal information when you provide it to us. “Personal information” (or “personal information”) is any information that can be used to identify you or that we can link to you. We may automatically collect certain information when you use, access, or interact with our Platforms. And we may collect information from other sources, such as social media platforms that may share information about how you interact with our social media content.

1. Information you provide to us.  We collect information that you provide to us, including when you communicate with us via email or other channels, including social media; when you sign up for or request that we send you newsletters, alerts, or other materials; when you sign up for a webinar or event; when you respond to our communications or requests for information; when you license or purchase any of our Products or services; when you provide camera access; video and streaming information.  Depending on the context of your interaction with use, the information you provide may include your name, your business name, contact information (including both home and work), title, email address, telephone number, birth date, other professional and educational information, health information, other geolocation information, audio and visual information, user content, preferences and any other information you choose to provide.  Some of our Platforms may require that you enter a password or other information in order to access certain features, and we collect such credentials when you enter them.  If you purchase or license any of our Products via this Platform, we will also collect credit card information.  We may also collect information if you provide it to us through the use of forms that you download from our Platforms, complete and send in to us, or through the use of forms such as Typeforms.

2. Information we may collect automatically.  We and our third party service providers use browser cookies and similar technologies (collectively, “Cookies”) to collect and store certain information when you use, access, or interact with our Platforms.  This information may include:

  • Unique Identifiers and Device Information: Including the type of device you use to access the Platforms, the operating system and version, your IP address, and geolocation information;
  • Browser Information: Including your browser type and version; and
  • Usage and Interaction Data: Such as the content you view and features you access on the Platforms, the web pages you view immediately before and after you access the Platforms, whether and how you interact with content available on the Platforms, the search terms you enter on the Platforms, and inferences drawn from your interaction with our Platforms.

The types of Cookies that we use include:

  • Strictly necessary Cookies: These Cookies are required for the essential operation of our Platforms such as to authenticate you and prevent fraudulent use;
  • Analytical/performance Cookies: These Cookies allow us to recognize and count the number of visitors and to see how visitors move around our Platforms when they are using it. This helps us to improve the way our Platforms work, for example, by ensuring that you can find information easily;
  • Functionality Cookies: These Cookies are used to recognize you when you return to our Platforms, enabling us to personalize our content for you, greet you by name and remember your preferences (for example, your choice of language or region); and
  • Targeting Cookies: These Cookies record your visit to our Platforms, the pages you have visited and the links you have followed. We will use this information to make our Platforms and the advertising displayed on it more relevant to your interests. We may also share this information with third parties for this purpose.

Additional Information

(a) Do Not Track Signals.  Please note that we do not currently respond to web browser “do not track” signals or other mechanisms that may allow you to opt out of the collection of information across networks of websites and online services as there is no standard for how online services should respond to such signals. As standards develop, we may develop policies for responding to do-not-track signals, which will be described in this Policy.

(b) Third-Party Cookies. Please note that third parties (including, for example, advertising networks and providers of external services like web traffic analysis services) may also use cookies, over which we have no control. These cookies are likely to be analytical/performance cookies or targeting cookies.

3. Information we collect from other sources.  We may obtain personal information from other sources, such as our clients, employees, or business partners, or from business contact databases and enrichment services. We may also receive information about you from social media platforms, such as when you interact with us on those platforms or access our social media content. We may collect information about you from publicly available sources, such as public social media profiles, publications, and other websites or materials available through search engines.

4. Precise location information

When you access the Platforms via a mobile device or other location-enabled method, we may collect precise location information if you permit the Platforms to access such information. We may use this information to provide you with content based on your location.

B. HOW WE USE THE INFORMATION WE COLLECT

We may use the information we collect for various purposes:

  1. To aggregate or link information about you from multiple sources;
  2. To respond to your inquiries;
  3. To market our Products and services and the Products and services of other entities;
  4. To provide you with Products and services that you request;
  5. To process payment for, and deliver any, Products that you license or purchase;
  6. To invite you to our social media accounts, pages and groups;
  7. To provide you with affiliate links;
  8. To operate, troubleshoot, and improve the Platforms;
  9. To send you newsletters, updates, marketing communications, and other information or materials that may interest you;
  10. To maintain our list of contacts;
  11. To understand how people use our Platforms and interact with our advertising, including by generating and analyzing statistics;
  12. For VVF’s business purposes, including data analysis; submitting invoices; detecting, preventing, and responding to actual or potential fraud, illegal activities, or intellectual property infringement;
  13. To assess the effectiveness of our events, promotional campaigns, and publications;
  14. To evaluate, recruit, and hire personnel;
  15. As we believe reasonably necessary or appropriate to: comply with our legal obligations; respond to legal process or requests for information issued by government authorities or other third parties; or protector your, our, or others’ rights;
  16. In another way that we indicate when we collect it; and
  17. Any other manner that you give us permission to do.

C. HOW WE MAY SHARE THE INFORMATION WE COLLECT

1. General Operations.  We may share your information in a number of ways and circumstances.  We may share your information in any way that we indicate at the time we collect it.  We may share information with our employees, contractors, consultants, alliance partners and vendors for business purposes such as internal administration, billing, information technology services, support and maintenance, fulfilling Product orders, promoting our events, Products and services, providing you with Products and services, and any of the actions that we have indicated anywhere in this Policy that we may take with regards to data and information.  We may also share the information we collect in other ways if you give us consent to those other ways.

2. We Do Not SellWe do not knowingly or intentionally sell your personal information or otherwise share information that reasonably identifies you with unaffiliated entities for their independent use except as expressly described in this Policy or with your prior permission. We may share information that does not reasonably identify you as permitted by applicable law.

3. Disclosures to Third Parties. We may also disclose information we collect:

(a) To our third-party service providers that perform services on our behalf, such as web-hosting companies, mailing vendors, analytics providers, event hosting services, and information technology providers.

(b) To law enforcement, other government authorities, or third parties (within or outside the jurisdiction in which you reside) as may be permitted or required by the laws of any jurisdiction that may apply to us; as provided for under contract; or as we deem reasonably necessary to provide you services. In these circumstances, we take reasonable efforts to notify you before we disclose information that may reasonably identify you, unless prior notice is prohibited by applicable law or is not possible or reasonable in the circumstances.

(c) Similarly, we may disclose personal information in order to comply with any other legal obligation, or in order to enforce or apply our Terms of Services or other agreements; or to protect the rights, property, or safety of VVF, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

(d) To service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a transaction in which we are acquired by or merged with another VVF or we sell, liquidate, or transfer all or a portion of our assets.

(e) We may promote our Platforms and Products by publishing advertising on our own Platforms and by placing ads on third parties’ services. We may use your Personal Information to model, segment, target, offer, market, and advertise our Platforms and Products.

4. Aggregate Information. We may share anonymous, de-identified, or aggregate information that cannot reasonably identify you with others for any purpose, as permitted by applicable law. Please note that any personal information that you post to a profile, blog, comment section, or forum on our Platforms (including our social media pages) may be available to other users of those forums or, in some cases, made publicly available.

5. Blogs. Our Platforms may include publicly accessible blogs or community forums. Any information you provide in these areas may be read, collected and used by others who access them. This includes information posted on our public social media accounts. To request removal of your personal information from our blog or community forum, contact us at [email protected]. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

6. Testimonials. With consent, we may display personal testimonials of satisfied customers on our site, along with other endorsements. If you wish to update or delete your testimonial, you can contact us at [email protected].

7. Grounds for using or processing your personal information.  Certain jurisdictions require that we have legal grounds for processing your personal information.   We rely on the following legal grounds to process your personal information, namely:

(a) Performance of a contract or order. We may need to collect and use your personal information to enter into a contract you or to perform a contract that you have with us, or to fulfill an order that you place for one of our Products. For example, when you use our Platforms we will use your personal information to respond to your requests and provide you with such services.

(b) Consent. By using our Platforms, you consent to our use of your personal information as described in this Policy.  If you object to such use, please cease all uses of the Platforms.  We may use precise location information as described in this Policy. You may be able to disable the sharing of location information in your browser or mobile application settings.

(c) Legitimate interests. We may use your personal information for our legitimate interests to improve our products and services and the content on our Platforms. Consistent with our legitimate interests and any choices that we offer or consents that may be required under applicable laws, we may use technical information as described in this Policy and use personal information for our marketing purposes.

(d) Legal Obligations. We may process personal information as necessary to comply with our legal obligations.

D. THIRD-PARTY SERVICES AND CONTENT

Our Platforms may include integrated content or links to content provided by third parties (such as video materials). This Policy does not address the privacy, security, or other practices of the third parties that provide such content.  We may engage third parties that support the operation of our Platforms, such as analytics providers. These third parties may use technologies to track your online activities over time and across different websites and online platforms. Please see above for how we use Cookies.

E. PROTECTION AND STORAGE OF THE INFORMATION WE COLLECT

1. Legal Precautions.  We take reasonable precautions to comply with applicable United States legal requirements and safeguard the information that we collect.  This includes, when appropriate and feasible, obtaining written assurances from third parties that may access your personal information that they will protect such information with safeguards designed to provide a level of protection equivalent to those adopted by us.  However, no information system can be 100% secure.  So, we cannot guarantee the absolute security of your information. Moreover, we are not responsible for the security of information you transmit to us over networks that we do not control, including the Internet, telephone and wireless networks, or even the information technology infrastructure of any of our vendors.

2. Location.  The Platforms are controlled and operated by VVF from the State of Florida, in the United States.  We do not intentionally market our services specifically to residents of any particular state.  We do not intentionally market our services to individuals located outside of the United States.  We may store the information we collect in the United States or in other countries where we or our service providers have facilities. We may transfer information to countries outside of your country of residence, including the United States, which may have data protection laws and regulations that differ from those in your country.  If you use or visit our Platforms from outside the United States, you expressly consent to the collection and/or processing in the United States of information we collect from or about you.  We do not intentionally market our Platforms to individuals located in the European Union.  If you reside outside of the United States, we make no representation as to whether our privacy practices comply with your country of residence.  If you are located in the European Union (“EU“), Switzerland or the  United Kingdom (“UK”), your personal information may be processed outside of the UK, Switzerland or EU, including in the United States.  While it is our goal to use appropriate safeguards, including Data Processing Addendums if proffered by our vendors, we cannot guarantee that your personal information will be processed in strict accordance with the laws of the UK, Switzerland and the EU.  We use commercially reasonable efforts to retain the information we collect no longer than as reasonably necessary to fulfill the purposes for which we collect the information and to comply with our legal obligations.  If you wish to inquire further about our foreign privacy law compliance, or wish to have your Personal Information removed, please contact us using the details set out at the end of this Policy.   California, Colorado, Connecticut, Nevada, Utah, and Virginia residents have certain rights with respect to their Personal Information. Those rights vary by state. If you are a resident of the above-mentioned states, you may exercise the rights applicable to you by submitting a request to us using the details set out at the end of this Policy.

3. Children.  We do not knowingly collect information from children under the age of thirteen (13), and our Platforms are not targeted to children under the age of thirteen (13).

F. YOUR CHOICES AND RIGHTS

1. If you no longer wish to receive marketing communications from us, you can let us know by sending us an email via our Contact Us page. And the electronic marketing communications we send you may contain unsubscribe opt-out mechanisms that allow you to register your marketing preferences.  Please note that if you opt-out of marketing communications, we may still contact you with non-promotional communications, such as those about ongoing business relations or administrative messages.

2. Subject to local law, you may have certain rights regarding information that we have collected and that is related to you. We encourage you to contact us to update or correct your information if it changes or if you believe that any information that we have collected about you is inaccurate. You can also ask us to see what personal information we hold about you, to erase your personal information and you may tell us if you object to our use of your personal information.  In some jurisdictions, you may have a right to complain to your local data protection authority. 3. If you reside in the EU or UK, VVF is the controller of your Personal Information for purposes of EU or UK data protection legislation. You also have the right to lodge a complaint to your local data protection authority. We may update this Policy from time to time. The effective date of the current Policy is noted at the top of this page. We encourage you to periodically review this page. If we make any material changes in the way we collect, use, and/or share the personal information that you have provided, we will notify you by posting notice of the changes on the VVF Platforms.
